Welcome to Planera. These Terms of Use ("Terms") govern your access to and use of the Planera mobile application (iOS and Android), the Planera website (planeraai.app), and all related services (collectively, the "Service"). By accessing or using Planera, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About Planera

Planera is an AI-powered travel planning platform that generates personalized travel itineraries and provides flight search and booking, destination recommendations, Low Fare Radar deal alerts, community travel insights, and an AI travel assistant (Atlas). Planera does not operate as a travel agency and does not sell, own, or control travel products or services.

Flight bookings are processed through Duffel, a licensed third-party booking platform. All bookings, payments, and contractual relationships for flights, accommodations, tours, and other travel services are made directly with the respective third-party providers.

2. Eligibility

You must be at least 18 years old to use Planera. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. User Accounts

To access certain features, you must create an account using email/password, Google Sign-In, or Apple Sign-In. You agree to:

• Provide accurate and up-to-date information
• Keep your login credentials secure and confidential
• Be fully responsible for all activity under your account
• Notify us immediately if you suspect unauthorized access

Planera reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Service Features

Planera provides the following features, subject to availability and your subscription tier:

4.1 AI Trip Generation

AI-generated day-by-day itineraries with activity recommendations, restaurant suggestions, timing, pricing estimates, and travel logistics. Trip generation uses trip credits (free tier: 1 credit; additional credits available via purchase or referral rewards).

4.2 Flight Search & Booking

Search and book flights directly within the app. Flight services are provided by Duffel. Planera facilitates the booking process but is not the airline or ticket seller. All flight contracts are between you and the operating airline.

4.3 Low Fare Radar & Deal Alerts

Monitor flight deals from your home airport, including alerts for watched destinations and wishlist matches. Deal information including prices and availability may change at any time and is not guaranteed.

4.4 Atlas AI Assistant

A conversational AI assistant that provides real-time travel advice, weather information, and restaurant recommendations. Atlas responses are AI-generated and should be verified independently.

4.5 Trip Collaboration & Sharing

Share trips with collaborators (editor or viewer roles) or generate public read-only share links. You are responsible for managing who has access to your trips.

4.6 Wishlist, Insights & Community

Save destinations to your wishlist, share travel insights with the community, and interact with others' tips. Community content is moderated and must comply with Section 10 (User Content).

4.7 Achievements, Streaks & Referrals

Earn achievements by using the app (e.g. booking flights, sharing insights, visiting destinations). Maintain daily check-in streaks. Refer friends using your unique referral code to earn trip credits for both parties.

5. Use of the Service

You agree not to:

• Use Planera for unlawful or fraudulent purposes
• Attempt to interfere with or disrupt the Service or its systems
• Copy, reverse-engineer, decompile, or exploit the Service without authorization
• Use automated systems (bots, scrapers) without prior written permission
• Create multiple accounts to abuse referral rewards or trip credits
• Submit false location data to unlock achievements
• Share inappropriate, misleading, or harmful content through community features
• Impersonate another person or misrepresent your identity

Planera may modify, suspend, or discontinue any part of the Service at any time without prior notice.

6. AI-Generated Content Disclaimer

The itineraries, recommendations, prices, availability, weather data, restaurant suggestions, and all other travel information provided by Planera are AI-generated and informational only.

• Information may be incomplete, outdated, or inaccurate
• Prices, availability, opening hours, and travel conditions are not guaranteed
• Restaurant recommendations, activity prices, and "skip the line" availability are estimates
• Weather forecasts are provided by third-party services and may not be accurate
• Travel conditions, visa rules, safety regulations, and local laws may change without notice

You are solely responsible for:

• Verifying all travel details, prices, and availability before booking
• Ensuring compliance with visa, health, entry, and passport requirements
• Making final travel decisions based on your own judgment
• Confirming opening hours, directions, and activity details independently

7. Flight Booking Terms

Flight search and booking is facilitated through Duffel. When you book a flight through Planera:

• The contract of carriage is between you and the operating airline
• Planera is not responsible for flight cancellations, delays, schedule changes, or denied boarding
• Baggage allowances, seat selections, and extras are subject to airline policies
• Refund and change policies are determined by the airline and fare rules, not by Planera
• Passenger information (including passport details) must be accurate — errors may result in denied boarding
• You are responsible for verifying that all passenger details match official travel documents exactly

8. Third-Party Services & Links

Planera integrates with or links to third-party services including (but not limited to) Duffel, OpenAI, TripAdvisor, Viator, Unsplash, Google, Apple, and various airlines and booking platforms. These services are governed by their own terms and privacy policies.

Planera:

• Is not responsible for third-party content, availability, pricing, or services
• Does not guarantee bookings, refunds, or customer support from third parties
• Cannot be held liable for any loss or damage arising from your use of third-party services

Any disputes regarding third-party services must be resolved directly with the relevant provider.

9. Payments & Subscriptions

9.1 Subscription Plans

Planera offers free and premium subscription tiers. Premium subscriptions provide unlimited trip generation, unlimited wishlist items, streak shield protection, and other benefits as described in the app.

9.2 In-App Purchases

• Subscriptions and trip credit packs are purchased through Apple's App Store
• Prices are displayed in your local currency before purchase
• Subscriptions renew automatically unless canceled at least 24 hours before the renewal date
• You can manage or cancel subscriptions through your Apple ID settings

9.3 Trip Credits

Free tier users receive 1 trip credit. Additional credits can be earned through referrals or purchased as trip packs (1, 3, or 10 credits). Credits are non-transferable and non-refundable.

9.4 Refunds

Subscription and in-app purchase refunds are handled by Apple according to their refund policies. Planera does not process refunds directly for App Store purchases.

10. User Content

If you submit content (such as travel insights, tips, feedback, or suggestions), you grant Planera a worldwide, royalty-free, non-exclusive license to use, display, moderate, and improve the Service based on that content.

You confirm that your content:

• Does not violate any laws or third-party rights
• Is not misleading, abusive, defamatory, or inappropriate
• Does not contain personal information of others without their consent
• Is your own original content or you have the right to share it

We reserve the right to moderate, reject, or remove user content at our discretion. Content goes through a review process (pending → approved/rejected/flagged) before being visible to other users.

11. Intellectual Property

All content, branding, software, design, AI models, and AI outputs provided by Planera are the intellectual property of Planera or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

You may not reproduce, distribute, modify, or exploit Planera content without prior written consent.

12. Limitation of Liability

To the maximum extent permitted by law, Planera shall not be liable for:

• Travel disruptions, cancellations, delays, or losses
• Injuries, damages, or expenses related to travel
• Errors or omissions in AI-generated content, including itineraries, prices, and recommendations
• Acts or omissions of third-party providers (airlines, hotels, tour operators)
• Incorrect passport or passenger information provided by you
• Loss of trip credits, streak progress, or achievement data due to technical issues
• Deals or fare alerts that are no longer available at the time of booking
• Unauthorized access to your account due to inadequate password security

Use of the Service is at your own risk.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. Planera does not guarantee:

• Uninterrupted or error-free access to the Service
• Accuracy, completeness, or timeliness of AI-generated content
• Availability or accuracy of flight prices, deals, or fare alerts
• Suitability of recommendations for your specific travel needs
• That notifications will be delivered on time or at all

14. Indemnification

You agree to indemnify and hold harmless Planera from any claims, damages, losses, or expenses arising out of:

• Your use of the Service
• Your violation of these Terms
• Your interactions with third-party providers
• Content you submit through community features
• Inaccurate information you provide (including passenger and passport details)

15. Termination

Planera may suspend or terminate your access at any time if you breach these Terms, abuse referral or credit systems, or misuse the Service. Upon termination:

• Your right to use the Service will immediately cease
• Unused trip credits are forfeited and non-refundable
• Active subscriptions should be canceled through your Apple ID settings
• You may request deletion of your personal data per our Privacy Policy

16. Privacy

Your use of Planera is also governed by our Privacy Policy, which explains how we collect, use, share, and protect your data — including data shared with OpenAI, Duffel, and other third-party services.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Greece, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Greece.

18. Changes to These Terms

Planera may update these Terms from time to time. Any changes will be posted within the Service with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes, we will notify you via the app or email.
